Tensing Retrial Headed Toward Hung Jury

The jury in the retrial of Ray Tensing appears to be headed toward another deadlock. After around 27 hours of deliberating the jury told Hamilton County Judge Leslie Ghiz they cannot come to a consensus and asked how they should proceed.

Just after 10 a.m. Friday, Ghiz sent the jurors back to deliberate a while longer.

"There is no reason to believe the case will ever be submitted to a jury more capable, impartial or intelligent as this one," Ghiz said. "Likewise there is no reason to believe that more or clearer evidence will be produced by either side. It is your duty to decide the case if you can conscientiously do so."

This instruction is known as an "Allen charge" or a "Howard charge."

Jurors began deliberating Monday afternoon.

Observers in the courtroom Friday morning described jury members as looking haggard.
