An Ohio judge is set to meet with both sides in the case of a white former University of Cincinnati police officer whose first trial in the fatal shooting of a black motorist ended in a hung jury.
Hamilton County Judge Megan Shanahan has scheduled a hearing for Monday after declaring a mistrial on Nov. 12.
Prosecutor Joe Deters has said he plans to retry Ray Tensing on the same charges of murder and voluntary manslaughter in the July 2015 shooting of Sam DuBose. Deters also said he wants the trial moved to another county, for a jury that won't be pressured by intense local attention.
Defense attorney Stewart Mathews has asked the judge to acquit Tensing. He has said he's leaning toward opposing a change of venue.
