Ohio State University lawyers are being given an opportunity to question fired marching band director Jonathan Waters in his federal defamation lawsuit.
In a Wednesday notice, the deposition of Jonathan Waters was set for Sept. 15.
The university fired Waters after an investigation concluded he ignored a "sexualized culture" inside the celebrated band.
Waters denies the charges and claims in his suit that the school discriminated against him because he was a man, failing to give him the second chance it gave a similarly-situated female employee. Ohio State denies the allegations.
U.S. District Judge James Graham is allowing Waters' attorneys to question only two people, Ohio State President Michael Drake and compliance investigator Chris Glaros. Drake's deposition was last week; Glaros will be questioned Friday.
