Death Row Inmate Reconsiders "Volunteer" Status

A condemned inmate who gave up his appeals ahead of Tuesday's execution has reconsidered and asked for an emergency delay.

Lorain County killer James Filiaggi asked the Ohio Supreme Court Friday in Columbus to stop his execution scheduled for Tuesday.

He says he needs the delay while a federal judge considers his request to join a lawsuit contending lethal injection constitutes cruel and unusual punishment.

Filiaggi says in his federal lawsuit that death by injection is unconstitutional because it will in effect cause him to be tortured to death.

Both the Ohio Parole Board and Governor Strickland have recommended against clemency for Filiaggi.
