Prosecutors and defense attorneys to decide next step in highway shooter case

Prosecutors and defense attorneys are scheduled to return to court to decide the next step in the highway shootings trial.

A hearing is scheduled Tuesday in the case of 29 year old Charles McCoy, the man accused of a string of Highway Shootings in Central Ohio.

Late Sunday, Judge Charles Schneider declared a mistrial after a jury informed him it could not reach a verdict. Prosecutor Ron O'Brien says the death penalty might not be part of a re-trial.

Capital University Law Professor Max Kravitz says the McCoy case is a legitimate insanity case, and that makes it troubling and difficult for a jury to decide.
