The lawyers for Luke Stewart’s family plan to appeal a judge's decision to dismiss their lawsuit against the Euclid Police Department.
Federal District Court Judge James Gwin on Friday dismissed the case against the city and the two police officers involved in the shooting.
In his written opinion, Gwin said Matthew Rhodes, the officer who shot Stewart, acted reasonably out of concern for his safety.
But Gwin also criticized the Euclid Police Department’s use-of-force training practices, calling its excessive force training regimen “dubiously supervised and organized” and wrote that the department seems to approach use-of-force with “cavalier indifference.”
Stewart was killed in March of 2017 after attempting to flee two officers who woke him up in his car.
Rhodes, the officer who shot Stewart, ended up in the passenger seat of Stewart’s car, tased him several times as Stewart drove away and eventually shot him five times.
