Franklin Co. prosecutor Favor files motions to quash subpoenas of attorneys in Coy case

Franklin County Prosecutor Shayla Favor has filed motions to quash subpoenas of the assistant prosecutors in the murder case of former Columbus police officer Adam Coy.

Coy was found guilty in November for killing Andre Hill in 2020. Before Coy could be sentenced, his defense team filed a motion for a new trial, alleging prosecutorial misconduct.

The defense team subpoenaed Assistant Prosecutors Anthony Pierson and Renee Amlin. Defense attorneys Mark Collins and Kaitlyn Stephens want them to turn over all communication they had with the expert they argue would have supported the defense's position.

Coy's attorneys argued prosecutors knew of a use-of-force expert who would have testified that Coy was justified in shooting Hill, but dismissed the expert after discovering his opinion didn't line up with those of the prosecutors.

Pierson responded in court documents that the expert only performed an incomplete surface review. Pierson said he didn't know what the expert's impression of the shooting was when he went with a different expert.

Pierson said the defense attorneys had their chance to use their own experts and the conviction should stand.

Favor argues in her motion to quash that the subpoenas are too broad, and the communications are not subject to disclosure because they are work products or covered under attorney client privilege. She states that if the court allows the subpoenas, that the records should be reviewed by the court to determine if they should be shared or placed under seal.

Franklin County Common Pleas Court Judge Stephen McIntosh is scheduled to consider the request and the motions for and against the move at a Jan. 17 hearing.

When Pierson ran in last year's Democratic primary for Franklin County prosecutor, Favor won the three-way race with 41% of the vote.
