Ohio AG challenges judge's hold on law banning gender-affirming care for minors

Organizers including clergy, business owners, social workers and transgender individuals gather in the Ohio Statehouse for a press conference on Wednesday, Dec. 13, 2023 in Columbus, Ohio in opposition to a bill that would ban gender-affirming care for minors and ban transgender athletes from participating in girls' and women's sports. The Ohio Republican-led state Senate cleared the measure along party lines Wednesday.

Ohio Attorney General Dave Yost has filed an emergency motion with the Ohio Supreme Court concerning House Bill 68.

Yost argued that Franklin County judge Michael Holbrook overstepped his judicial authority by placing a hold on the law that bars gender-affirming care for transgender minors.

Yost said the injunction is unlawful because it "applies to the entire state, rather than just the two plaintiffs who challenged the law."

The ACLU of Ohio, which filed the lawsuit, has stated that families should be able to make their choices based on the advice of their physicians and free from interference from politicians.
