Environmental Activists Sue Ohio Secretary Of State Over Ballot Initiatives

Some environmental advocates have sued Ohio's secretary of state and several county boards of elections over what the lawsuit calls unconstitutional tactics preventing certain ballot initiatives from going before voters.

Cleveland.com reports the lawsuit filed recently in Youngstown says that allowing the secretary of state and elections boards to review ballot measures' substance rather than just whether or not they conform to state law is unconstitutional.

Members of environmental activist groups from Athens, Franklin, Lucas, Mahoning, Medina, Meigs and Portage counties say they had initiatives unconstitutionally blocked from the ballot.

The lawsuit wants the parts of Ohio law allowing "substance, content-based review" by elections officials invalidated.

Maggie Sheehan, spokeswoman for Ohio Secretary of State Frank LaRose, told Cleveland.com that office doesn't comment on pending litigation.
