The state says a review of a condemned Ohio inmate's medical records finds no evidence of an allergy to anesthesia beyond the man's own statements.
The Ohio Attorney General's Office said in a court filing Friday that nothing in Darryl Durr's records show a reaction to any type of anesthesia, including the drug used in Ohio executions.
Durr has raised allergy concerns ahead of his execution, scheduled for Tuesday.
The filing says the references to the allergy come solely from Durr's own statements that he's allergic to general anesthetic.
The filing also says Durr has taken a painkiller used in Ohio's backup execution method without problems.
Also Friday a federal judge refused to stop the execution based on Durr's request for more DNA testing.
