Westerville Taxpayer Group Wants Chance At Ballot
A Westerville taxpayer group is asking the Ohio Supreme Court to allow its proposed repeal of a suburban school district’s 2009 levy to appear on the November ballot.
In the appeal,Â Taxpayers for Westerville Schools seeks an expedited decision from justices given the Sept. 22 deadline for finalizing ballots.
The filing on Thursday follows Tuesday’s unanimous vote by the Franklin County Board of Elections scrubbing the repeal from the fall ballot.
The 1851 Center for Constitutional Law represents the taxpayer group. The center relied on a rarely used state law that subjects school issues that increase a tax’s rate to repeal by voters.
Election board members said the levy didn’t fall under the provision because it was a renewal that didn’t generate additional revenue.
